    Abstract:
    The exigency to address the fallacy of the Marital Rape exception has been a long-standing debate in India. Marital rape is largely inherent to the patriarchal nature of the Indian society and it deprives the rights of women concerning bodily integrity and autonomy. A number of petitions have been filed across various Courts challenging the constitutionality of the Marital rape Exception. The Delhi High Court referred the instant case to the Supreme Court to decide the legality of marital rape considering the gravity of the question of law involved in the same.
